Terms of Use

Nixotine is a self-help tool, not a medical device or a substitute for professional care. It does not diagnose, treat, or cure anything. Before making changes to your nicotine use — especially if you have a health condition, are pregnant, or take other medications — talk to a qualified healthcare professional. 1. Agreement to these terms

These Terms of Use (“Terms”) are a legal agreement between you and Serkan Coşkun (“Nixotine,” “we,” “us,” or “our”) governing your use of the Nixotine iOS application and the website at nixotine.app (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. What Nixotine is

Nixotine is a personal, self-help tool designed to support people who want to reduce or stop using nicotine — including vaping, nicotine pouches, and snus. It helps you track progress, get through cravings with guided breathing, and see health and financial milestones. It is intended for motivation and self-management only.

3. Not medical advice

Nixotine does not provide medical advice and is not a healthcare provider. Any information in the Service — including health-recovery milestones and quit content — is general and for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment, and you should never disregard or delay seeking professional advice because of something in the Service.

Quitting nicotine can involve withdrawal effects. If you experience concerning physical or mental symptoms, seek help from a qualified healthcare professional. Always consult your doctor before changing your nicotine use if you are pregnant or breastfeeding, have a medical condition, or take medication.

4. Eligibility

You must be old enough to legally purchase nicotine products where you live, and at least the minimum age required to use the App Store, to use the Service. By using Nixotine, you confirm that you meet these requirements. The Service is not intended for children.

5. Subscriptions, pricing, and billing

Nixotine offers a free tier and an optional paid subscription (“Nixotine Pro”). Pro may be offered on a monthly or annual basis and may include a free trial.

  • Payment. Subscriptions are sold and billed through your Apple ID via the App Store. We do not process your payment directly and never see your payment details.
  • Free trial. If a free trial is offered (for example, 3 days), you won't be charged until the trial ends, unless you cancel before it does. Any unused portion of a trial is forfeited when you purchase a subscription.
  • Auto-renewal. Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
  • Managing and cancelling. You can manage or cancel your subscription anytime in your device's Settings → your Apple ID → Subscriptions. Cancelling stops future renewals; it does not retroactively refund the current period.
  • Price changes. Prices may change over time. Where required, we or Apple will notify you, and material increases will not apply to your current period without your consent.
  • Refunds. Purchases are handled by Apple, and refunds are subject to Apple's policies. We generally cannot grant refunds directly; please request them through Apple.

6. Your licence to use the app

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Nixotine for your own personal, non-commercial use on Apple devices you own or control, as permitted by the App Store terms.

7. Acceptable use

You agree not to: (a) copy, modify, reverse engineer, decompile, or attempt to extract the source code of the Service, except as allowed by law; (b) resell, sublicense, or commercially exploit the Service; (c) use it in any unlawful way or to infringe others' rights; or (d) interfere with or disrupt the Service or its security.

8. Intellectual property

The Service, including its software, design, text, graphics, the Nixotine name and logo, and all related content, is owned by us or our licensors and is protected by intellectual-property laws. These Terms don't transfer any ownership to you. Your own data that you enter into the app remains yours.

9. Third-party services

The Service relies on third parties including Apple (App Store and payments) and RevenueCat (subscription management), and the website uses Google Analytics and Netlify. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not guarantee that using Nixotine will cause you to quit or reduce nicotine use, or that it will be uninterrupted, error-free, or accurate. Results depend on many personal factors outside our control.

11. Limitation of liability

To the fullest extent permitted by law, Nixotine and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us (if any) for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, and this does not affect your statutory consumer rights.

12. Indemnification

You agree to indemnify and hold us harmless from claims and expenses arising out of your misuse of the Service or your violation of these Terms or applicable law, to the extent permitted by law.

13. Changes and termination

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms; when we do, we'll change the “Last updated” date, and continued use means you accept the revised Terms. We may suspend or end your access if you materially breach these Terms.

14. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. This choice of law does not deprive you of the protection of mandatory consumer-protection rules of the country where you live.

15. Apple App Store — additional terms

Because you download Nixotine from the Apple App Store, the following apply between you and us, and you acknowledge that Apple is a third-party beneficiary of these Terms and may enforce them:

  • These Terms are between you and us only, not with Apple. Apple is not responsible for the app or its content.
  • Your licence to use the app is limited to Apple devices you own or control, as set by the App Store's Usage Rules.
  • Apple has no obligation to provide maintenance or support for the app. Questions about the app should go to us at nixotineapp@gmail.com.
  • To the extent permitted by law, Apple has no warranty obligation for the app, and any warranty claims are our responsibility.
  • Apple is not responsible for addressing product-liability, legal/regulatory, or third-party intellectual-property claims relating to the app.
  • You represent that you are not in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country, and that you are not on any U.S. Government restricted-parties list.
  • Your use is also subject to Apple's standard licensed-application end user licence agreement (the “Standard EULA”).
